1. Agreement

These Terms of Service (“Terms”) govern your use of the website operated by Kiwi Urban Living LLC (“Kiwi,” “we”). By using the site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site. You must be at least 18 years old to submit a form.

2. Who we are — and who we are not

Kiwi is a privately owned housing company. We are not HUD, not a public housing agency, and not a government actor. We do not issue housing vouchers, do not control waitlists, and do not determine program eligibility. Information about Section 8, veterans programs, and state housing vouchers is general only and is not legal advice or an official program description.

3. Nature of the site

• The site is for information and contact. It is not a rental application, not a waitlist with legal rights, and not a binding offer to rent.
• Photographs and property-type descriptions are illustrative. They are not listings of specific units, addresses, rents, or availability.
• No rent, deposits, or screening fees are collected through this site.
• Any tenancy arises only from a written lease and, where assistance is used, from the subsidy contract the issuing agency requires.
• Company statements about “welcome,” “prepared for inspection,” or similar goals are policies, not warranties and not part of any future lease unless restated in that lease.

4. Housing assistance

We welcome lawful rental assistance as a company policy, including Section 8, veterans housing programs, and state housing voucher programs. Acceptance of a particular program on a particular unit is always subject to that program’s rules, agency inspection and approval, rent reasonableness or payment standards, available inventory, and otherwise lawful screening. We do not guarantee that an inspection will pass or that a subsidy will be approved.

5. Inquiries

Submitting a contact or waitlist form is a request for information. It does not reserve a unit, establish a tenant relationship, or place you on a government waitlist. You agree that the information you send is accurate to the best of your knowledge and does not include sensitive identity documents. We may decline to respond to abusive, unlawful, or incomplete submissions.

6. Permitted use

Use the site only for lawful purposes. You may not: submit false or defamatory content; attempt unauthorized access; scrape the site with automated tools except ordinary search engines; interfere with security or capacity; or impersonate another person.

7. Intellectual property

Site content is owned by Kiwi Urban Living LLC or its licensors. You may view it for personal, non-commercial use. Any other reproduction or commercial use requires our prior written permission.

8. Fair Housing

We are an equal housing opportunity provider. See our Fair Housing Policy. These Terms do not limit any non-waivable fair-housing right.

9. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that information is complete or current, that the site will be uninterrupted, or that a home will be available when you inquire.

10. Limitation of liability

To the maximum extent permitted by law, Kiwi Urban Living LLC and its members, officers, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from use of this website. Our total liability arising from the website itself will not exceed one hundred U.S. dollars (US $100). This limit does not apply to liability that cannot be limited under applicable law, and it does not change rights or duties that later arise under a signed lease.

11. Indemnity

You will indemnify and hold Kiwi Urban Living LLC harmless from claims arising out of your misuse of the site or your violation of these Terms, except to the extent caused by our willful misconduct.

12. Third-party services

The site may link to HUD, housing agencies, or other third parties. Those sites have their own terms. Form submissions are emailed to info@kiwiurbanliving.com via a form-to-email processor, as described in the Privacy Policy.

13. Registered office

The Sheridan, Wyoming address published on this site is our registered office. It is not a public leasing office and is not an invitation to visit without an appointment.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Exclusive venue for disputes arising from the website is the state or federal courts sitting in Sheridan County, Wyoming, except that we may seek injunctive relief in any court. If a property later leased to you is in another state, the lease — not these website Terms — will govern that tenancy.

15. Changes; severability

We may update these Terms by posting a new version with a new effective date. If a provision is held unenforceable, the rest remains in effect. These Terms are the entire agreement about use of the website.
